Limited Warranty
Torginol, Inc. warrants to the original buyer that its products will be free from defects in material and workmanship, for a period of one (1)
year from the date of shipment, under normal use and proper care, and in compliance with reasonable and necessary maintenance requirements. This limited warranty applies only to manufacturing defects in material and workmanship existing at the time of shipment and does not apply to or cover any damage to the products which is caused in whole or in part by any other reason, including, without limitation, improper installation, improper substrate construction, exposure of the products to solvents and/or higher concentration of acids than that for which the products or their components are designed and loss of bond due to moisture transmission, vapor pressure and capillary action or moisture within, under or adjacent to the surface to which the products were applied. Except as set forth herein Torginol, Inc. makes no representation or warranty, expressed or implied, with respect to its products and, furthermore, has excluded any warranties as to the merchantability and fitness for a particular purpose. Buyer and any subsequent buyer assume all risk and liability for product deterioration
and for losses resulting from the use of products in combination with other products. Any claim for breach of this limited warranty shall be deemed waived unless made in writing and received by Torginol, Inc. within one (1) year of the shipment date. The sole remedy and Torginol, Inc.’s sole responsibility in the case of such a breach of this limited warranty shall be for Torginol, Inc. to replace the products supplied by Torginol, Inc. with respect to which such limited warranty is breached. In no case shall Torginol, Inc. have any liability or obligation for incidental, special or consequential damages with respect to its products, including, without limitation, loss of material or
profits, increased operation expenses, bodily injury, loss of use of property or downtime, whether arising under contract, tort, strict liability or other theory. While Torginol Inc., and its representatives may from time to time offer recommendations and advice with respect to its
products or the installation of its products, any such recommendations and advice are not warranties as to the accuracy of such
representations and advice. Any action of buyer or any subsequent buyer taken upon any such recommendations and advice is at such
buyer’s sole discretion and risk. |
